Ubisoft re-selling torrent?

If you buy the Digital Deluxe edition of the PC version of Assassin's Creed: Brotherhood, which is released tomorrow, you'll also get the game's soundtrack. A user on Reddit (this delightful source of Internet drama) took a look at the soundtrack files and noticed that they were encoded by someone called "arsa13" - which is the username of the person who ripped and then distributed the music on the soundtrack included in the original Collector's Edition. Does this mean that Ubisoft downloaded those files and are now selling them as a part of the Digital Deluxe edition?

Ubisoft themselves have yet to comment on the whole thing. Some people have asked if this means that Ubisoft, or at least one of their employees, are guilty of piracy - of course, the question is if they are really guilty of piracy if they own the rights to the music in the first place, no matter the source. The torrent technology is, in itself, not illegal at all. If it's ethical or not is a whole other question.
